Terms of sale
This is a translation, provided for convenience. The French version is the authoritative one.
These terms govern the sale and use of Tack+, an app for Mac. They serve as both general terms of sale and terms of use: the product is simple, so a single text is enough.
1. Purpose and acceptance
The seller and publisher of Tack+ is Pensa Corporation, the name under which 1001771571 ONTARIO INC. operates, a corporation incorporated in Ontario (Canada), corporation number 1001771571, with its registered office at 570 Hood Rd, Markham, Ontario L3R 4G7, Canada, and whose full contact details appear in the legal notice. It is referred to below as “the publisher”. Payment is processed by Polar (polar.sh), which acts as reseller (Merchant of Record).
The buyer is a natural person acting outside their professional activity, unless otherwise stated at the time of the order. The buyer is referred to below as “you”.
Placing an order constitutes acceptance of these terms, in the version displayed on that day. A later version does not apply to an order already placed.

2. The product
Tack+ is an app for macOS. It pins a thin bar to the bottom or top edge of the screen; you push the cursor into it, and a panel slides out. It gives access to fifteen apps (sixteen with Mac+, if installed) and three tools. Using it requires an account, described in Section 10.
- macOS 14 or later.
- Apple silicon and Intel.
- About 12 MB of disk space.
The purchase is a one-time purchase. There is no subscription, no renewal, and no subsequent charge.
Tack+ controls apps already installed on your Mac and reads certain local data, with the permissions that macOS asks you for. You may refuse them: the features concerned are then inactive, and the rest works. The details are described on the Privacy page.
3. Price
Prices are stated in United States dollars (USD).
| Plan | Price | Period |
|---|---|---|
| Welcome offer | USD $10 | Until October 31, 2026, 11:59 p.m. (Paris time) |
| Regular price | USD $20 | Thereafter |
The price displayed at the time of the order is the price that applies. A later increase is never charged to you. Polar, which collects the payment, displays the exact amount in your currency, including taxes, before you confirm.
The publisher is a company established in Canada. Since payment is handled by Polar as reseller (Merchant of Record), any VAT or equivalent tax that may be due in your country of residence is calculated, collected and remitted by Polar at the time of payment, and displayed before the order is confirmed.
4. Ordering and payment
Orders are placed on the website, after creating an account.
Payment is made by bank card, on the secure page of our provider Polar (polar.sh), to which you are redirected after clicking “Buy”. The publisher neither collects nor stores any card data.
The sale is concluded upon actual payment of the price. The charge constitutes acceptance of the order. A confirmation email is sent to you, and the license is immediately linked to your account: Tack+ unlocks on all your Macs signed in to that account.
If a payment goes through without the license being activated, write to support@pensacorp.com with the transaction reference: the license will be activated manually, or the purchase refunded.
After payment, the app is downloaded from your account, on the website, and updates itself. No physical medium is shipped: Tack+ is digital content supplied by download.
5. License to use
The purchase does not make you the owner of the software. It grants you a personal, non-exclusive and non-transferable right of use, for an unlimited period.
This right covers:
- installing and using Tack+ on all the Macs of which you are the user;
- making one backup copy.
This right does not cover:
- redistributing, making publicly available or lending the app;
- reselling, renting or transferring the license to a third party;
- modifying, decompiling or reverse engineering, beyond what is permitted by Articles L122-6 and L122-6-1 of the French Intellectual Property Code, in particular for interoperability purposes;
- removing or altering proprietary notices.
Tack+, its code, its name and its graphic elements remain the property of Pensa Corporation (1001771571 ONTARIO INC.).
6. Right of withdrawal
You have fourteen days to change your mind, starting from the conclusion of the contract. This is the period set by Article L221-18 of the French Consumer Code.
An email to support@pensacorp.com is sufficient. No justification is required, and no form is imposed. The refund is made no later than fourteen days after receipt of your request, using the same means of payment as for the order.
You may also use the model withdrawal form provided in the annex to Article R221-1 of the French Consumer Code, reproduced below and adapted to digital content. Copy it into an email or attach it.
Model withdrawal form
(Please complete and return this form only if you wish to withdraw from the contract.)
To Pensa Corporation (1001771571 ONTARIO INC.), 570 Hood Rd, Markham, Ontario L3R 4G7, Canada, email address support@pensacorp.com:
I/We (*) hereby give notice that I/we (*) withdraw from my/our (*) contract for the supply of the following digital content: Tack+, app for macOS.
Ordered on (*)/received on (*):
Name of consumer(s):
Address of consumer(s):
Signature of consumer(s) (only if this form is notified on paper):
Date:
(*) Delete as appropriate.
Article L221-28 13° of the French Consumer Code would allow this right to be excluded for digital content not supplied on a physical medium whose performance has begun with your consent. The publisher does not make use of it: the fourteen-day period remains open to you even after downloading and using the app. This is more favorable than the legal minimum; it is a choice, not an obligation.
After the refund, the license is deactivated and you stop using Tack+.
7. Legal guarantees
In all cases, you benefit from the following legal guarantees. Nothing in this text reduces them.
- Legal guarantee of conformity: Articles L224-25-12 et seq. of the French Consumer Code, specific to digital content. The app must match its description and its expected use. A lack of conformity entitles you to have it brought into conformity, and failing that, to a price reduction or to termination of the contract.
- Guarantee against hidden defects: Articles 1641 to 1649 of the French Civil Code.
Tack+ is supplied in a single act, by download. For this case, Article D211-3 of the French Consumer Code requires the following box, reproduced in the terms of the official model (translated from French):
The consumer has a period of two years from the supply of the digital content or digital service to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity appearing. During a period of one year from the date of supply, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
The legal guarantee of conformity entails an obligation to supply all updates necessary to maintain the conformity of the digital content or digital service.
The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following their request, free of charge and without significant inconvenience to them.
The consumer may obtain a price reduction while keeping the digital content or digital service, or may terminate the contract and obtain a full refund in exchange for giving up the digital content or digital service, if:
1° The professional refuses to bring the digital content or digital service into conformity;
2° Bringing the digital content or digital service into conformity is unjustifiably delayed;
3° Bringing the digital content or digital service into conformity cannot take place without costs being imposed on the consumer;
4° Bringing the digital content or digital service into conformity causes significant inconvenience to the consumer;
5° The lack of conformity of the digital content or digital service persists despite the professional’s unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a price reduction or to termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to first request that the digital content or digital service be brought into conformity.
Where the lack of conformity is minor, the consumer is entitled to cancellation of the contract only if the contract does not provide for payment of a price.
Any period during which the digital content or digital service is unavailable for the purpose of bringing it back into conformity suspends the remaining period of the guarantee until the digital content or digital service is supplied again in conformity.
The rights mentioned above result from the application of Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.
A professional who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 242-18-1 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee gives entitlement to a price reduction if the digital content or digital service is kept, or to a full refund in exchange for giving up the digital content or digital service.
For everything else, the software is provided as is. The publisher does not guarantee that it will meet a particular need that is not described, nor that it will operate without any interruption.
Any claim under these guarantees is made to support@pensacorp.com.
8. Updates
Updates are included in the purchase. They are not charged for.
The publisher makes no commitment as to the duration, frequency or content of future versions. A feature may be modified or removed, in particular if a third-party app or macOS changes.
Updates necessary to maintain the conformity of the product, as provided for by Article L224-25-25 of the French Consumer Code, remain due for the period provided for by law.
9. Service availability
Tack+’s features run on your Mac. The website and the account service, however, may be interrupted: maintenance, outage, technical changes.
The account service is required to sign in and to verify the license on each Mac. Once you are signed in, the saved session and the last verified license, kept in the macOS Keychain, keep the panel available offline, just as during an interruption. A new sign-in and settings sync, however, wait until the service is restored.
10. The account
An account is required to use Tack+: the panel unlocks once you are signed in to an account that holds a purchased license.
The account is used to find your license on each of your Macs, and to carry four settings over from one Mac to another: the Notepad contents, Shortcuts favorites, the chosen music source and the Home layout.
You are responsible for keeping your credentials confidential. You may request the deletion of your account at any time; Tack+ then locks, but the purchased license remains yours: it can be linked to a new account upon presentation of proof of purchase.
The data processed and its hosting are described on the Privacy page.
11. Third-party apps
Spotify, Apple Music, Messages, Mail, Safari, Notes, Shortcuts and the other apps mentioned belong to their respective publishers. Their names and trademarks remain theirs.
The publisher is not affiliated with any of these publishers, nor sponsored or endorsed by them. Tack+ merely controls these apps on your Mac, with the permissions you grant.
The publisher does not guarantee their operation, their availability, or the continued existence of the interfaces on which Tack+ relies. If one of them changes, a Tack+ feature may stop working, without this engaging the publisher’s liability beyond its legal conformity obligations.
These apps have their own terms. They apply to your use of those apps.
12. Liability
The publisher is liable for direct and foreseeable damage caused by a breach of its obligations.
It is not liable for damage that is not attributable to it: improper handling, hardware incompatibility, a defect in third-party software, loss of data that was not backed up, force majeure.
Except in the case of gross negligence or willful misconduct, and except for bodily injury, any compensation that may be due shall not exceed the price paid for the license.
These limits apply neither to the legal guarantees in Section 7 nor to the right of withdrawal in Section 6.
13. Governing law and disputes
These terms are governed by French law.
If a problem arises, first write to support@pensacorp.com. Most situations are resolved there.
If the reply does not satisfy you, you may use consumer mediation free of charge, in accordance with Articles L611-1 et seq. of the French Consumer Code. To find out which mediator is competent and how to refer a matter to them, write to support@pensacorp.com.
Failing agreement, the dispute falls under the jurisdiction of the French courts. As a consumer, you may bring the matter before either the court of the place where you resided at the time the contract was concluded, the court of the place where the harmful event occurred, or the court of the publisher’s registered office, in accordance with Article R631-3 of the French Consumer Code.
14. Changes to the terms
The publisher may change these terms for future orders. The version applicable to your purchase is the one displayed on the day of the order; keep a copy of it if you wish.
